Rapid City compost & food-waste ordinance compliance.

Rapid City's nuisance code makes odor, pests, uncontained grease, and visible food waste a citable offense — with a 7-day clock once Code Enforcement knocks. Here's what the ordinance actually says, and how a scheduled pickup keeps you out of it.

What the ordinance says

The four nuisance categories that touch food waste.

Verbatim excerpts from Rapid City Municipal Code 8.16.010. Read the full chapter for the complete enumeration.

8.16.010(C) — Compost piles

Onsite compost piles that smell, harbor disease, or attract pests

Any compost pile which is of such a nature as to spread or harbor disease, emit unpleasant odors or harmful gas, or attract rodents, vermin or other disease carrying pests, animals or insects…

How we help: We pick up sealed bins on a schedule. Material leaves your property before it can turn into a pile that draws complaints, rodents, or flies.

8.16.010(C) — Food odors

Vegetable matter and food waste that emit offensive odors

All vegetables, vegetable matters, or other articles that emit or cause an offensive, noxious or disagreeable smell or odor…

How we help: Sealed, lined totes with gasketed lids contain back-of-house odor between pickups. We swap clean totes — no hosing, no lingering smell at the dock.

8.16.010(C) — Grease & fats

Oil, grease, fat, or hazardous material not properly contained and covered

Any oil, grease, fat, or hazardous material, that is not properly contained and covered… Any ground area… that has been covered by or otherwise negatively impacted by oil, grease, fat, or a hazardous material…

How we help: Greasy food scraps go in our compost stream; liquid FOG stays with your grease hauler. We help you map the line between the two so neither one ends up on the pavement.

8.16.010(C) — Visible waste

Waste stored, collected, or piled in view of adjacent properties or the public right-of-way

…items… stored, collected, piled or kept on private or public property, and in view of adjacent properties or public right-of-ways.

How we help: Right-sized bins behind your enclosure mean less overflow, fewer bags on the ground, and a dumpster lid that actually closes.

Our approach

What scheduled compost pickup actually changes.

The ordinance regulates conditions: smells, pests, grease on the ground, waste in view. We don't make any of those go away by magic — we move the material that causes them off your site on a cadence that fits your volume.

  • Sealed, lined totes with gasketed lids — odor stays in the bin, not at the dock.
  • Scheduled swaps so food waste never sits long enough to draw rodents or flies.
  • Right-sized service that lets your dumpster lid actually close.
  • Weight-ticket receipt after every pickup — a paper trail if Code Enforcement asks.
  • Clear in/out signage so staff don't accidentally toss FOG or hazardous material in the compost.

Got a code-enforcement notice?

You have 7 days. We can help you use them.

Under RCMC 8.16.035, a first notice gives you 7 calendar days to remedy or abate the nuisance (3 days for a repeat in the same calendar year). If the city has to abate for you, the cost — plus administrative fees — can be special-assessed against the property. Call us the day you get the notice and we'll work to get a sealed bin onsite and pickup scheduled inside your remediation window.
